55 Club - Terms of Service

Use of the site

By accessing or using 55clubwin.in.net (the "Site"), you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms of Service in full. Access to the Site is permitted on a temporary basis, and 55 Club reserves the right to withdraw or amend the services provided on the Site without notice.

Permitted use

You may use the Site solely for lawful purposes and in a manner consistent with all applicable local, state, national, and international laws and regulations, including those of India. You must not use the Site in any way that causes, or is likely to cause, disruption, damage, or impairment to the Site or to the experience of other users. Any attempt to probe, scan, or test the vulnerability of the Site or to breach its security or authentication measures is strictly prohibited.

Prohibited conduct

When using the Site, you must not introduce viruses or other malicious code; use automated bots or scrapers without prior written consent from 55 Club; collect personal data of other users without authorisation; or engage in any conduct that restricts or inhibits other users' enjoyment of the platform. Breach of these restrictions may result in immediate suspension or permanent termination of your access, at 55 Club's sole discretion and without prior notice.

Account responsibility

If you register an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. You must notify 55 Club immediately upon becoming aware of any unauthorised use. 55 Club is not liable for any loss or damage arising from your failure to safeguard your account information.

Intellectual property

All content published and made available on the Site is the property of 55 Club or its respective content suppliers and is protected under applicable intellectual property laws, including the Copyright Act, 1957, and the Trade Marks Act, 1999, as in force in India. These Terms of Service grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Site for personal, non-commercial purposes only.

Ownership of content

The Site and its entire contents, including but not limited to text, graphics, logos, images, audio clips, software, and the overall look and feel of the platform, are the exclusive property of 55 Club or its licensors. The 55 Club name, logo, and all related marks are trademarks of 55 Club. Nothing in these Terms of Service transfers any intellectual property rights to you, and all rights not expressly granted herein are reserved by 55 Club.

Restrictions on use

Without the prior written permission of 55 Club, you must not copy, reproduce, republish, download, transmit, or make available to the public any content from the Site; modify or create derivative works from any Site material; remove proprietary notices; or use any content for commercial purposes. Unauthorised use may give rise to a claim for damages and could constitute a criminal offence under applicable Indian law.

Limitation of liability

To the fullest extent permitted by applicable law, 55 Club, its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the Site or any content thereon.

No warranties

The Site and all content, materials, and services provided through it are offered on an "as is" and "as available" basis without any warranty of any kind, whether express or implied. 55 Club does not warrant that the Site will be uninterrupted, error-free, or free from viruses or other harmful components. You assume full responsibility for any risk associated with your use of the Site, including any reliance on the accuracy or completeness of information available on the platform.

Cap on liability

Where liability cannot be excluded by law, the total aggregate liability of 55 Club to you for any claim arising out of or related to these Terms of Service shall not exceed the greater of INR 500 or the total amount paid by you to 55 Club in the three months immediately preceding the event giving rise to the claim. Nothing in these Terms of Service limits liability for fraud, wilful misconduct, or any other liability that cannot lawfully be excluded or restricted.
